Scope of Application of the Conditions
Use of the Application implies acceptance of the Conditions by the User. If the User does not intend to accept the Conditions and/or any other note, legal notice, or information published or referred to herein, they may not use the Application or its related services.
The applicable Conditions are those in force on the date of transmission of the purchase order or request for supply of a Product.
Before using the Application, the User is required to read the Conditions carefully and to save or print them for future reference.
The Owner reserves the right to change at their discretion, at any time even subsequent to the User's registration, the graphical interface of the Application, the Contents and their organization, as well as any other aspect that characterizes the functionality and management of the Application, communicating the relevant instructions to the User, where necessary.

Purchase or supply request through the Website
All Products offered through the Application are described in detail on the respective product pages (quality, features, availability, price and delivery costs, ancillary charges, etc.). Some errors, inaccuracies, or minor differences between what is published on the Application and the actual Product may occur. Furthermore, any images of the Products are for illustrative purposes only, without prejudice to the product conformity guarantees.
Purchases and/or requests for the supply of one or more Products through the Application are permitted for Consumer Users.
For natural persons, purchases and/or requests for supply are permitted only on the condition that they are of legal age. For minors, any purchase and/or request for the supply of Products through the Application must be examined and authorized by parents or those exercising parental responsibility.
The offering of Products through the Application constitutes an invitation to offer, and the order sent by the User will be considered a contractual proposal for purchase and/or supply request, subject to confirmation and/or acceptance by the Owner as described below. Therefore, the Owner will have the right, based on objective reasons related to availability or internal verifications, to accept or decline the User's order, without the User being entitled to object or complain on any grounds and/or reason whatsoever.
The contract for the sale or supply of the Products is understood to be concluded with the acceptance by the Owner of the User's contractual proposal. The Owner will accept the User's contractual proposal by displaying an order confirmation web page, which will report the date of the order, the User's data, the characteristics and availability of the Product, the price or the method for calculating the price, any additional ancillary charges and taxes, the delivery address and any delivery costs, the procedures for exercising the right of withdrawal or its eventual exclusion, and the warranty.
The contract for the sale or supply of Products is not considered effective between the parties in the absence of what is indicated in the previous point.
In the event that the Product is not available, the Owner will inform the User of the new delivery or supply terms, asking whether they intend to confirm the order or not. It is understood that the contract will be considered completed relatively to the Products accepted by the Owner.
The User undertakes to verify the correctness of the data reported in the order confirmation and to immediately communicate any errors to the Owner, and will ensure to keep a copy of their order, the relative confirmation, and the Conditions.

The User guarantees that the personal information provided during the registration procedure is complete and truthful and undertakes to hold the Owner harmless and indemnified from any damage, compensation obligation and/or penalty deriving from and/or in any way connected to the violation by the User of the rules on registration to the Application or on the preservation of registration credentials.

Account cancellation and closure

In the event of a breach by the User of the Conditions or applicable legal provisions, the Owner reserves the right to suspend or close the User's account at any time and without prior notice.

Prices and payments
For each Product, the price shown is inclusive of VAT, if applicable. If the nature of the Product makes it impossible to calculate the price in advance, the method for calculating the price will be provided.
In addition, any applicable taxes, additional charges, and delivery costs will be indicated, which may vary depending on the destination, the chosen delivery method, and/or the payment method used. If these expense items cannot reasonably be calculated in advance, there will be an indication of which costs will be charged to the User.
The Owner reserves the right to modify, at any time, the price of the Products and any additional costs. It is understood that any price changes will in no case affect contracts already concluded before the modification.
The User undertakes to pay the price of the Product within the times and in the manners indicated on the Website and to communicate all necessary data that may be requested.
The Website uses third-party tools for payment processing and does not come into contact in any way with the payment data provided (credit card numbers, holder's name, passwords, etc.).
Should such third-party tools deny payment authorization, the Owner will not be able to provide the Products and cannot be held responsible in any way.

Invoicing
Users who wish to receive an invoice will be requested to provide their billing details during the purchase process. For the issuance of the invoice, the information provided by the User shall prevail, which the User declares and guarantees to be true, fully indemnifying the Owner in this regard.

Delivery Methods and Timelines
Material Products will be delivered to the address indicated by the User during the order process. The Owner undertakes to manage, process, and entrust the Products to the express courier for shipment in the shortest possible time and, in any case, no later than the maximum term of 30 days provided by law from the order confirmation. Shipping costs are borne by the User and are clearly calculated and displayed before payment.
Unless otherwise specified, the delivery terms indicated correspond to the period of time usually necessary to deliver the Product from the moment it is taken over by the express courier. In the event that it is not possible to supply the requested Products, timely notice will be given via e-mail to the User, indicating when they are expected to be delivered or the reasons that make the supply impossible. If the User does not intend to accept the new term or delivery has become impossible, they may request a refund of the amount paid, which will be credited within 14 days using the same means of payment chosen by the User for the initial transaction.
Upon receipt of the Product, the User is required to verify its compliance with the order placed. In the event of evident damage to the packaging or the Product, the User may refuse delivery of the Product or accept it "subject to checking" to be written on the courier's slip. Any anomalies not detectable at the time of delivery must be promptly reported to the Owner via e-mail at info@cristinadimilano.com.
The Owner shall not be liable to any party or third parties for damages, losses, and costs incurred as a result of the failure to execute the contract due to force majeure or fortuitous events.

Right of Withdrawal and Use of the Online Button
The Consumer User has the right to withdraw from the purchase contract, without having to provide any reason, within 14 days from the day on which the User or a third party, other than the carrier and designated by the User, acquires physical possession of the Products.
In accordance with Art. 54-bis of the Italian Consumer Code, the Consumer User may exercise this right in a simplified manner by clicking on the specific "Online Withdrawal Button" present on the website and filling in the minimum required data, or by sending an explicit communication or the optional form to the e-mail address info@cristinadimilano.com. The Owner will send an acknowledgment of receipt of the withdrawal via e-mail without delay.
IMPORTANT – Management for orders already shipped: If the User exercises the right of withdrawal (via the Online Button or any other method) after the package has already been entrusted to the courier for shipment, the order cannot be blocked in transit. The User will still be required to regularly receive the package upon arrival.
The direct costs of returning the Products (including return courier shipping fees and any return customs duties for non-EU shipments) shall be borne entirely by the Consumer User.
The Product must be returned intact, in its original packaging, unused, and undamaged. The refund of the amounts paid (equal to the price of the purchased Product) will take place within 14 days, but will be withheld by the Owner until the physical receipt of the Product at their premises and subject to verification of its total integrity and eligibility for resale.

Legal Warranty of Conformity of Material Products for Consumer Users
In accordance with the Consumer Code (Arts. 128-135-septies), all Products sold through the Website are covered by a Legal Warranty of Conformity lasting for 24 months from the delivery date of the goods. The legal warranty is exclusively reserved for Consumer Users.
1. Conformity requirementsThe Owner undertakes to deliver Products that conform to the sales contract. Footwear is presumed to conform if it is fit for the purposes for which goods of the same type are normally used, if it conforms to the description provided on the Website, and if it possesses the normal quality and performance that the User can reasonably expect, taking into account the nature of handcrafted fabric footwear.
The warranty exclusion section clarifies that faults or malfunctions caused by specific factors are not considered manufacturing defects and are excluded from the warranty of conformity. The text focuses on defining the limits of warranty coverage for product defects .
    • Normal wear and tear due to prolonged use over time (e.g., natural wear of the sole).
    • Improper, negligent use, or use not compliant with the footwear's intended purpose (e.g., use under heavy rain or on rough terrain for footwear designed for indoor/light urban use).
    • Improper maintenance or washing methods not suitable for the type of fabric or velvet, which alter its structure, color, or shape.
    • Danni accidentali provocati dall’Utente o da terzi successivi alla consegna.

An action brought to assert lack of conformity is subject to a limitation period of 26 months from the delivery of the Product. This requirement, along with the burden of proof, is standard in consumer protection regulations.
    • Any lack of conformity appearing within 12 months of delivery is presumed to have existed at that time, unless incompatible with the nature of the goods or defect. The warranty excludes defects caused by specific, non-manufacturing factors, and actions for lack of conformity are subject to a 26-month limitation period from delivery.
    • After the 12-month period from delivery has elapsed, the Consumer User will bear the burden of proving that the lack of conformity already existed at the time of delivery and did not result from subsequent or incorrect use of the footwear.

In the event of an ascertained lack of conformity, the Consumer User has the right, at their choice and free of charge, to have conformity restored through the repair or replacement of the Product [1]. This applies unless the requested remedy is objectively impossible or excessively burdensome for the Owner compared to the alternative.
The Consumer User is also entitled to a proportional reduction in the price or to the termination of the sales contract (with subsequent refund) if:
    • Repair or replacement is impossible or excessively burdensome.
    • The Owner has not provided for the repair or replacement within a reasonable period.
    • A lack of conformity manifests itself despite the Owner's attempt to restore the goods.
    • The lack of conformity is so serious as to justify an immediate price reduction or termination.

How to activate the warranty
To claim under the warranty, the User must send a written communication to the email address info@cristinadimilano.com info@cristinadimilano.com providing a description of the defect and, where possible, supporting photographic material. The Owner will provide a timely response indicating the shipping methods for the Product to undergo technical verification.

User-Submitted Content
Users may upload content such as reviews, comments, and images, provided it is not illegal, misleading, or harmful, and they accept full responsibility for any third-party disputes. The user agrees to indemnify the Owner against any damages or expenses arising from such content.
The User guarantees that the Content is submitted to the Website through their account by individuals of legal age. For minors, the submission of Content must be previously reviewed and authorized by parents or legal guardians.
The User is fully and exclusively responsible for using the Website regarding the publication and management of Content and is therefore the sole guarantor of the accuracy, completeness, and legality of the Content itself. Moderation and Removal of Content (DSA Compliance)
The Owner does not carry out a prior and systematic check on all Content received. However, in accordance with applicable European regulations (Digital Services Act), the Owner reserves the right to remove, obscure, or modify Content that clearly violates these Conditions or applicable legal provisions, or following a substantiated report from third parties or competent authorities. The removal will be notified to the User where possible and reasoned on the basis of these regulations.

License to Use Content
Upon submitting Content (e.g., a review with a photo of the footwear), the User grants the Owner a non-exclusive, perpetual, transferable, and completely free right of use, without geographic limitations, for the sole purpose of hosting, publishing, distributing, and promoting such Content within the Website or on official communication and social media channels linked to the CRISTINAdiMILANO brand.
Submitted Content will not be returned, and the Owner shall not be liable to Users for the loss, modification, or destruction of the transmitted Content.
It is expressly prohibited, unless explicitly authorized in writing by the Owner: i) the use of automatic systems for loading data or advertisements, ii) the serial publication and/or management of advertisements on behalf of third parties by any means or methods, iii) reselling the Owner's services or products to third parties.

Industrial and Intellectual Property Rights
The Owner declares to be the owner and/or licensee of all intellectual and industrial property rights related and/or pertaining to the Website and the Content available thereon.
Therefore, all trademarks, whether figurative or nominative, logos, trade names, wordmarks, illustrations, photographs, texts, descriptions, as well as the design, stylistic lines, footwear models, prototypes, and ornamental combinations of the Products present on the Website are and remain the exclusive property of the Owner or its licensees, and are protected by applicable laws on trademarks, patents, copyright, and relevant international treaties.
These Conditions do not grant the User any license for use or any exploitation rights regarding the Website and/or individual content, products, or materials available therein, unless expressly authorized in writing by the Owner. You can provide the next block of text for translation.

Prohibition of Data Extraction and Web Scraping
The use of automated systems, robots, crawlers, scrapers, or other software tools aimed at extracting, copying, indexing, or reusing, in whole or in part, data, product images, and texts present on the website, including for the purpose of training artificial intelligence systems, is expressly prohibited without the prior written consent of the Owner.
Any unauthorized reproduction, imitation, distribution, or commercial use, in any form, of the Website Content or of the graphic and structural models of the footwear, will be prosecuted to the fullest extent of the law in both civil and criminal courts for infringement of copyright, industrial property, and for unfair competition.

Limitation of Liability for Website Operation
The Website is provided "as is" and "as available" for use by the User, with no express or implied warranty from the Owner regarding the total absence of interruptions, errors, computer bugs, or viruses, despite efforts to adopt appropriate technical and organizational security measures to protect the platform. These excluded warranties refer solely to the technological operation of the site and do not affect the Legal Warranty of Conformity on Products purchased by Consumer Users.
The Owner will make every effort to ensure that the Website is available 24 hours a day without interruption, but shall in no way be held liable if, for any reason, the Website is inaccessible and/or non-operational at any time or for any period.
Access to the Website may be temporarily suspended without notice in the event of system failure, routine or extraordinary maintenance activities, repairs, or for reasons entirely beyond the Owner's control, or due to events of force majeure or unforeseeable circumstances. In such cases, the Owner shall not be liable for any damages or losses arising from the temporary unavailability of the website.

Limitation of Liability
Except in cases of willful misconduct or gross negligence, the Owner shall not be held liable to the User for any service disruptions or malfunctions related to the use of the internet that are beyond the control of the Owner or its subcontractors.
The Owner is not liable for damages or costs resulting from non-performance of the contract due to circumstances beyond their control, such as force majeure, with the User only entitled to a full refund.
The Owner assumes no liability for any fraudulent or unlawful use that may be made by third parties of credit cards and other means of payment when settling the balance for purchased products, as the Owner does not come into contact in any way with the payment data used (credit card numbers, holder's name, passwords, etc.), which are securely processed by third-party payment gateways.
The Owner shall not be liable for:
    • Any loss of business opportunity and any other loss, even indirect, that may be suffered by the User that is not a direct and immediate consequence of the breach of contract by the Owner.
    • Incorrect or improper use of the Website and Products by Users or third parties.
    • The issuance of incorrect tax documents or data due to errors in the information provided by the User, with the latter being solely responsible for the correct entry of such data during checkout.

Without prejudice to the mandatory rights granted to the Consumer User by law and the Consumer Code, the Owner's overall liability is limited to direct and foreseeable damages at the time the contract is concluded.

Force majeure and unforeseeable circumstances
The Owner shall not be held liable for any failure or delay in performing their contractual obligations if such failure or delay is caused by circumstances beyond their reasonable control due to events of force majeure or unforeseeable circumstances (including, but not limited to: natural disasters, floods, fires, general transport or logistics strikes, customs delays, government measures, wars, epidemics, or widespread internet network outages).
The performance of obligations by the Owner shall be deemed suspended for the period during which the events of force majeure occur. The Owner will make every effort within their power to find solutions that allow for the proper fulfillment of their obligations despite the persistence of the event.
In the event of force majeure or unforeseeable circumstances lasting over 30 consecutive days and preventing footwear delivery, either party may terminate the contract via written notice. Upon termination, the Consumer User is entitled only to a full refund of payments made, with no further compensation or claims against the Owner.

The Website may contain hyperlinks (links) to websites, applications, or platforms managed by third parties. The Owner exercises no operational control over them and, therefore, is in no way responsible for the content, legality, security, or operation of such external sites.
Some links on the website redirect to third-party services, such as payment processors or shipping trackers, for operational purposes. In these instances, the terms of service and privacy policies of those specific third-party providers apply exclusively.
The Owner assumes no liability for any damages, malfunctions, or personal data breaches resulting from the use of or access to such third-party websites and services, which occurs at the User's sole risk.

The Consumer User retains the right to bring an action before a court other than the "consumer's court" in accordance with applicable national regulations or international conventions.
The application to Consumer Users who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence is expressly reserved (with particular reference to protections on the right of withdrawal, return terms, and the legal warranty of conformity).

In the event that any clause or provision of these Conditions is declared null, void, invalid, ineffective, or voidable (in whole or in part) by a competent Judicial or supervisory Authority, such invalidity shall not affect the validity, legitimacy, and effectiveness of the remaining clauses, which shall continue to have full force and effect between the Parties.
The provision deemed invalid or ineffective shall be automatically replaced, where possible, by the applicable mandatory legal provisions on the matter (with particular reference to the protections of the Consumer Code), in order to keep the contractual balance and the original intent of the Parties unaltered.
